Legal & Ethical issues

In terms of photo shoot, this might be in terms of misrepresentation, copyright, royalties
LEGAL
In terms of legal issues, these tends to be about who owns the rights to something, or whether you are slandering (saying something about someone that is not true), or sometimes it can be a legal issue of making sure your content is not breaking the law (as in there is no suffering to animals depicted)
ETHICAL
Ethics are more of a minefield and there are certain ethical considerations that we have in the west that are important to understand. Ethics is about what society views as right.
Such as – is there a balance between male/female genders?
If there are, are these stereotypical roles (e.g. powerful and strong male, weak female often dressed provocatively)
Is there swearing, are there weapons?

Southpark is controversial because a lot of people disapprove of its ethics. However, the producers might argue that it is for a small cult audience who are adult enough to know what is right and what is wrong.

Where appropriate to the output, we should:

-gather material using first hand sources wherever possible
-check and cross check facts
-validate the authenticity of documentary evidence and digital material
-Corroborate claims and allegations made by contributors wherever possible.
In news and current affairs content, achieving due accuracy is more important than speed.

I believed that I followed these guidelines because the facts I found I checked them on more than one source and I knew they were true because there were quite a few sources and I did know most of the facts myself anywhere because I used the product quite a lot and my guest on the podcast clearly knew a lot about the product as well as they had some facts that I have heard about before.
Fairness, Contributors and  consent






The BBC strives to be fair to all - fair to those our output is about, fair to contributors, and fair to our audiences.  BBC content should be based on respect, openness and straight dealing.  We also have an obligation under the Ofcom Broadcasting Code to "avoid unjust or unfair treatment of individuals or organizations in programmes".

I believed that I followed these guidelines because I was fair as I didn’t say one game mode was awful in the game and one game mode was great as that would be completely unfair to the different people who created each game mode and I also I did not force the people in my podcast to be in it I asked and they agreed.


Privacy




The BBC respects privacy and does not infringe it without good reason, wherever in the world it is operating.  The Human Rights Act 1998 gives protection to the privacy of individuals, and private information about them, but balances that with a broadcaster's right to freedom of expression.  In regulation, the Ofcom Broadcasting Code states "Any infringement of privacy in programmes, or in connection with obtaining material included in programmes, must be warranted."

I believed that I followed these guidelines because I did not reveal any information of my guests that could affect him in a bad way all the people who listen to my podcast would only know my guests name and his opinion on a game nothing like where he lives or what he does which could make people hate him. And If I was to say some of that stuff then I would have to get permission of my guest to release that information.

The BBC aims to reflect the world as it is, including all aspects of the human experience and the realities of the natural world.  In doing so, we balance our right to broadcast innovative and challenging content, appropriate to each of our services, with our responsibility to protect the vulnerable and avoid unjustifiable offence.

I believed that I followed these guidelines because I did not offend anyone by deliberately saying one player from one nationality is better than another from another nationality as people would say that is racist for example if I said someone from England is better than someone from china then I would be accused of racism and also because I prefer to play a certain game mode and I don’t usually play that many others if my guest was to say he liked a mode that I didn’t like I couldn’t just say “ that game mode is so bad why do you like it”.  

Conflict of interest





A conflict of interest may arise when the external activities of anyone involved in making our content affects the BBC's reputation for integrity, independence and high standards, or may be reasonably perceived to do so.  Our audiences must be able to trust the BBC and be confident that our editorial decisions are not influenced by outside interests, political or commercial pressures, or any personal interests.

I believed that I followed these guidelines because I did not let any outside interests make me change what I was going to say. Things that could have made me change what I was saying would be YouTube videos, live streams and friend’s opinion of the product. I did not say anything like “I saw this video and so now that is my opinion because the person who made the video is a good mate”.



Impartiality



Impartiality lies at the heart of public service and is the core of the BBC's commitment to its audiences.  It applies to all our output and services - television, radio, online, and in our international services and commercial magazines.  We must be inclusive, considering the broad perspective and ensuring the existence of a range of views is appropriately reflected.

I believed that I followed these guidelines because I did not say anything bad about the products rival so for Fifa the rival game would be PES as it also makes a football game and each game competes with each other to see which game is more enjoyed by the people who play it.

In consideration of the sum of £0 and any other good and valuable considerations, receipt of which is hereby acknowledged, I, being of legal age, hereby give Josh’s Fifa podcast, their licensees, successors, legal representatives, and assigns the absolute and irrevocable right and permission to use my name and to use, reproduce, edit, exhibit, project, display, copyright, publish and/or resell photography images and/or moving pictures and/or videotaped images and/or audio recordings of me with or without my voice, or in which I may be included in whole or in part, photographed, taped, videotaped, audio recording and/or recorded on 19th September 2017 and thereafter, and to circulate the same in all forms and media for art, advertising, trade, competition of every description and/or any other lawful purpose whatsoever. I also consent to the use of any printed matter in conjunction therewith.

I hereby waive any right that I may have to inspect and/or approve the finished product or products or the editorial, advertising, or printed copy or soundtrack that may be used in connection therewith and any right that I may have to control the use to which said product, products, copy and/or soundtrack may be applied.

I hereby release, discharge and agree to save Josh’s Fifa podcast, their licensees, successors, legal representatives and assigns from any liability by virtue of any blurring, distortion, alteration, optical illusion or use in composite form whether intentional or otherwise that may occur or be produced in the making, processing, duplication, projecting or displaying of said picture or images, and from liability for violation of any personal or proprietary right that I may have in conjunction with said pictures or images and with the use thereof.
